Constitutional lawyer and writer Glen Greenwald makes his case against Kagan in an article by the same name http://www.salon.com/news/opinion/glenn_greenwald/2010/04/13/kagan , in which he articulates that Kagan, in replacing Justice John Paul Stevens, would actually move the Court to the right.
Kagan as the Obama pick begs the question; why? I for one am deeply concerned about the further movement of our Supreme Court away from the Constitution. How far are liberals willing to go in order to keep supporting any and all of Obama’s policies or actions?
Greenwald makes a clear case in opposition to the Kagan pick and vociferously argues against her 2001 paper, during the Bush presidency, in favor of expansive executive power via executive branch agencies over congressional powers, on today’s 5-10-10 broadcast of Democracy Now www.democracynow.org .
